ParkPal Terms of Service

Welcome to ParkPal! These terms govern your use of our application and website ("Service"). By using our Service, you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

1. Disclaimer of Affiliation

ParkPal is an independent service and is not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with The Walt Disney Company, or any of its subsidiaries or affiliates. The official Disney website can be found at www.disney.com. The names Disney, Walt Disney World, as well as related names, marks, emblems, and images are registered trademarks of their respective owners.

2. Your Eligibility

To use ParkPal, you must:

  • Be at least 18 years old.
  • Provide accurate and complete registration information.
  • Agree to our Privacy Policy, which is incorporated into these Terms.

3. The Service

Our Service provides timely notifications about the availability of dining reservations and Lightning Lane passes at Walt Disney World. You agree to receive emails or SMS messages as part of these notifications.

We do our best to provide accurate and timely information, but availability is controlled by Disney and is outside of our control. All notifications are provided on a best-effort basis and are not guaranteed.

4. Payments

Certain features of the Service may require payment. All transactions are securely processed by our third-party payment processor, Stripe. We do not store your full payment information.

5. Acceptable Use and User Conduct

You agree not to:

  • Use ParkPal for any illegal or unauthorized purpose.
  • Scrape, copy, reverse-engineer, or otherwise misappropriate our Service or data.
  • Interact with our Service in a malicious way, including interfering with its operation or security.
  • Use the information provided by our Service to violate the terms of service of any third party, including The Walt Disney Company.

6. Your Responsibility

You are solely responsible for your use of the Service and for any consequences thereof. This includes ensuring that your use of ParkPal and any actions you take based on our notifications (such as making bookings on Disney's systems) comply with all applicable third-party terms and policies, including those of The Walt Disney Company.

7. Intellectual Property

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. ParkPal content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of ParkPal and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of ParkPal or our licensors except as expressly authorized by these Terms.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE INFORMATION PROVIDED WILL BE ACCURATE, RELIABLE, OR COMPLETE. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PARKPAL LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES (SUCH AS MISSED RESERVATIONS OR OPPORTUNITIES) RESULTING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless ParkPal, LLC, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right, or the terms of service of any third-party.

10. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.

11. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

13. Governing Law

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes will be resolved in accordance with the arbitration provision set forth in Section 12 above.
